REFUND, CANCELLATION & BILLING POLICY

Effective Date: October 5, 2026

This Refund, Cancellation & Billing Policy (“Policy”) constitutes an agreement between you (“Customer,” “you,” or “your”) and Empire Offshore (“Empire Offshore,” “we,” “us,” or “our”).

By accessing or using Empire Offshore services or completing any payment, you acknowledge and agree to the terms of this Policy. If you do not agree with this Policy, you should not purchase or use our services.

1. Billing Method & Payment Processing

Empire Offshore may use third-party payment processors, including Stripe, to securely process payments and manage subscriptions.

  • Payments may be processed securely through Stripe or another authorized payment provider.
  • Empire Offshore does not have access to your complete payment card information.
  • Charges may occur when you voluntarily complete a checkout process or authorize recurring billing.
  • By completing a payment or subscription checkout, you authorize the applicable payment provider to charge your selected payment method according to the pricing, billing frequency, and terms presented at checkout.

2. Subscription Terms

Where Empire Offshore provides services on a recurring subscription basis:

  • Payment is due in advance at the beginning of each billing period.
  • Recurring subscriptions may automatically renew unless cancelled.
  • Your payment method may be charged automatically on the applicable renewal date.
  • Charges continue until the subscription is cancelled.
  • Unused service hours, credits, or allocated resources do not automatically roll over unless expressly stated otherwise in writing.

Specific subscription terms may vary depending on the service or package purchased.

3. Cancellation Policy

You may request cancellation of a recurring service at any time, subject to the applicable service agreement and billing terms.

How to Cancel

You may cancel by:

  • Using the subscription or billing portal provided to you, where available; or
  • Contacting Empire Offshore through the official contact information provided on our website.

Unless otherwise stated in your service agreement, cancellation will normally take effect at the end of the current paid billing period.

You will generally retain access to the applicable services until the end of the period for which payment has already been made.

4. Managing Your Subscription

Where subscription management is available through a third-party billing portal, you may be able to:

  • Upgrade your plan.
  • Downgrade your plan.
  • Cancel your subscription.
  • Update your payment method.
  • Update billing information.
  • Review invoices and payment history.

Changes to subscriptions may result in immediate or future billing adjustments depending on the applicable plan and payment provider.

For assistance with your subscription, please contact Empire Offshore through our official contact channels.

5. Refund Policy

Unless otherwise agreed in writing:

  • Monthly or recurring payments are non-refundable once the applicable billing period has started.
  • Payments for services already performed, delivered, or initiated are generally non-refundable.
  • No refunds or credits are provided for unused service hours, unused capacity, partial billing periods, or lack of account activity.
  • Unused hours or allocated resources do not automatically roll over to future billing periods.
  • Third-party costs, including software subscriptions, advertising spend, hosting, domains, platform fees, communication charges, and other external expenses, may be non-refundable.

Any refund issued outside these terms will be determined at the sole discretion of Empire Offshore, subject to applicable law.

6. Service Hours

Certain Empire Offshore packages may include a defined number of service hours or allocated resources.

Where applicable:

  • Service hours are allocated according to the purchased plan.
  • Hours are intended for use during the applicable billing period.
  • Unused hours expire at the end of the billing period.
  • Unused hours do not automatically roll over.
  • Additional service hours may be purchased where available.
  • Service hours cannot be exchanged for cash or transferred to another customer unless agreed in writing.

The number of hours and services included will depend on the specific package purchased.

7. Pausing Services

Unless specifically agreed in writing, Empire Offshore does not guarantee the availability of a subscription “pause” option.

If you need to stop recurring services, you may cancel your subscription and restart services at a later date.

Restarting services may be subject to:

  • Team availability
  • Current pricing
  • Updated service packages
  • New onboarding requirements
  • Changes in scope or service availability

8. Project-Based Services

For one-time projects such as website development, application development, funnel development, automation setup, CRM implementation, AI agent development, or other customized work, payment and refund terms may differ from recurring subscriptions.

Project deposits, milestone payments, or setup fees may be non-refundable once work has commenced because resources may have already been allocated to the project.

The applicable proposal, quotation, invoice, or service agreement may contain additional project-specific terms.

9. Third-Party Costs

Some Empire Offshore services may require third-party platforms or software.

Examples may include:

  • GoHighLevel

  • Twilio
  • Meta

  • A partial refund
  • A prorated credit
  • Additional service time

Each situation will be reviewed individually.

Providing an exception in one situation does not create an obligation to provide the same exception in future situations.

11. Chargebacks & Payment Disputes

If you believe a payment was processed incorrectly, please contact Empire Offshore before initiating a chargeback or payment dispute so that we have an opportunity to investigate and resolve the matter.

For legitimate disputes, Empire Offshore may provide the applicable payment processor with relevant documentation, which may include:

12. Failed Payments

If a recurring payment fails, Empire Offshore or its payment provider may attempt to process the payment again.

If payment remains unsuccessful, Empire Offshore may:

  • Temporarily suspend services.
  • Restrict access to services.
  • Pause active work.
  • Cancel the subscription.
  • Require outstanding balances to be paid before services resume.

Any work or services paused because of non-payment may be subject to availability when the account is restored.

13. Taxes and Additional Charges

Depending on your location and applicable laws, taxes, payment processing fees, government charges, or other applicable fees may be added to the advertised or agreed price.

The applicable amount will be communicated during checkout, invoicing, or contracting where required.
